Some person just called to tell me they are planning to take legal action against me for non-payment of a bill. This is extra special because it is a bill that, while yes, I probably do owe, I have never seen. When last I spoke to this individual, I asked him to send me a copy of the bill at work. I gave him the work address, but lo, no bill came. So today he's calling me saying he's going to call his lawyers, and I say "Send me the bill". Mais non. He has already sent the bill (to the gods know where) and will not send it again. So he says "Well, I'm sorry, but I'm just going to have to turn it over to my attorney". So that's a fun way to start one's week.
Happy Monday, everybody.

time to call

Robin...bet he can help sort it out. That happened to me - but at least they sent the bill again. Bastardy. Sorry babe.

Standard IANAL disclaimer applies.

Doubt if it will turn out serious ... part of the determining factor in legal judgements is determined by how well the person seeking damages attempted to mitigate those damages. As you have requested to see the bill before you pay it and he won't provide it, he isn't attempting to mitigate his damages ... which the courts frown on.

Likely his attorney will advise him of this as well and you will probably receive a bill via some form of mail requiring a signature in order to receive it.

Best of luck!

:-) Would ya like help from your legal collector lj/gaia bud? I can call and speak with him if you would like, or my next suggestion would be to wait for the demand letter to come from the attorneys office. Because according to the FDCPA they have to supply you with docs before they sue you. Another possibilty is to call him back and ask for his attorney's name, so that you do not have to wait for the demand letter. There are a lot of what ifs and without knowing the whole path of this collection or nature of the collection it's hard to advise you. However, feel free to give me an e-mail.

Kill 'em! Kill 'em alllllll!

I'm sorry, I seem to be channeling Xena today. It would solve the problem, though...

I really like this solution, except of course, our lovely friend/lj bud and gaia pal, who just happens to be one of those pain in the . . .
